Terms and Conditions between User and Phalanx Aviation
Nature of Service — Marketplace Disclaimer
Phalanx Aviation operates an online marketplace that connects aircraft owners and operators (“Customers”) with independent, FAA-certificated Airframe & Powerplant (“A&P”) mechanics (“Mechanics”). Phalanx Aviation does not perform aircraft maintenance, inspections, or repairs. Phalanx Aviation does not employ Mechanics. All Mechanics listed on or contacted through phalanxaviation.com are independent contractors who operate their own businesses and are solely responsible for the services they perform, the prices they charge, the tools and parts they use, and compliance with all applicable FAA regulations. Any contract for maintenance services is formed solely between the Customer and the Mechanic. Phalanx Aviation is not a party to that contract
General
Customer is referred to in this text as any individual who visits phalanxaviation.com or uses Phalanx Aviation products and/or services. Mechanic is referred to in this text as any mechanic doing business with Phalanx Aviation. Phalanx Aviation is A DBA of MAS Aviation LLC. Phalanx Aviation’s services and products are offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your agreement to obtain products and/or services from Phalanx Aviation constitutes your agreement to all these Terms. Please read these terms carefully, and save the link to these terms and conditions. Saving the link ensures that mechanics and customers have the most up to date version of these terms.
Electronic Communications
Visiting phalanxaviation.com or sending emails to Phalanx Aviation constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
SMS Messaging
By providing your phone number and submitting your information to Phalanx Aviation, you consent to receive text messages from Phalanx Aviation regarding your maintenance requests, service updates, and account notifications. Insurance and Mechanic Qualifications
Phalanx Aviation does not provide, procure, require, or verify insurance coverage of any kind for Mechanics listed on the platform. Phalanx Aviation does not set minimum insurance limits. The decision to carry insurance, and the type and limits of any such coverage, is solely at the discretion of each independent Mechanic.
Customers are solely responsible for verifying, prior to authorizing any work: (a) the Mechanic’s FAA certification status and ratings; (b) the Mechanic’s experience with the Customer’s aircraft; (c) the existence, type, and limits of the Mechanic’s insurance coverage; and (d) any other qualifications the Customer deems relevant. Phalanx Aviation makes no representation or warranty regarding any Mechanic’s qualifications, certifications, insurance, or workmanship
Disclaimer of Warranties
The Phalanx Aviation platform and all listings and referrals are provided on an “AS IS” and “AS AVAILABLE” basis. Phalanx Aviation disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy of listings, and quality or safety of services performed by any Mechanic

Phalanxaviation.com has not reviewed, and cannot review, all of the material, including computer software, made available through any third party websites and webpages to which Phalanxaviation.com links, and that link to Phalanxaviation.com. Phalanxaviation.com does not control such websites and webpages and is not responsible for their contents or their use. Such links should not be interpreted as approval by Phalanxaviation.com of those linked websites or information you may obtain from them. By linking to a website or webpage, Phalanxaviation.com does not represent or imply that it endorses such website or webpage. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, logic bombs, and other material that is malicious or technologically harmful (collectively, the “Technologically Harmful Content”). Indemnification
The Customer agrees to indemnify and hold harmless and defend Phalanx Aviation member(s), officers, employees, and contractors from and against all claims and suits for damages, injuries to persons (including death), property damages, losses, and expenses including court costs and reasonable attorney’s fees, arising out of, or resulting from, Phalanx Aviation’s performance under this Agreement, including all such causes of action based upon common, constitutional, or statutory law, or based in whole or in part, upon allegations of negligent or intentional acts on the part of Phalanx Aviation, its officers, employees, agents, contractors, licensees, or invitees.
Arbitration
All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the state of Iowa. An award of arbitration may be confirmed in a court of competent jurisdiction.
Changes to Terms
Phalanx Aviation reserves the right, in its sole discretion, to change these terms. The most current version of the Terms will supersede all previous versions. Phalanx Aviation encourages you to periodically review the Terms to stay informed of our updates.
