Agreement between User and Phalanx Aviation
General
Customer is referred to in this text as any individual who visits phalanxaviation.com or uses Phalanx Aviation products and/or services. Mechanic is referred to in this text as any mechanic doing business with Phalanx Aviation. Phalanx Aviation is A DBA of MAS Aviation LLC. Phalanx Aviation’s services and products are offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your agreement to obtain products and/or services from Phalanx Aviation constitutes your agreement to all these Terms. Please read these terms carefully, and save the link to these terms and conditions. Saving the link ensures that mechanics and customers have the most up to date version of these terms.
Electronic Communications
Visiting phalanxaviation.com or sending emails to Phalanx Aviation constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.
Customer Accepting Jobs
Customers are encouraged to keep a copy of these terms and conditions for future reference. By accepting a job customer agrees to adhere to these terms and conditions.
Customer Late Accounts / Mechanic Lien
Customer accounts are considered late after 7 days of invoice delivery to customer. Phalanx Aviation will automatically proceed with the process of filing a Mechanics Lien on customer late accounts. This lien will be filed on the aircraft with the Federal Aviation Administration. Customers will receive appropriate notifications as the Mechanic lien process is applied. Late amounts will incur interest at the highest interest rate applicable by law or 1.5% percent per month, which ever is greater.
Insurance Of Work Performed
Phalanx Aviation does not provide insurance for mechanics working on customers aircraft. It is the decision of the individual mechanic performing the work if he or she would like to obtain insurance. By accepting these terms the aircraft owner understands, and accepts that Phalanx Aviation does not provide insurance.
Mechanic Payments
If mechanics are using Phalanx Aviation’s assistance to complete a job. Mechanics will be paid once job is completed. Payment method to be agreed upon by Phalanx Aviation and Mechanic.
Links to Third Party Sites/Third Party Services
Phalanxaviation.com has not reviewed, and cannot review, all of the material, including computer software, made available through any third party websites and webpages to which Phalanxaviation.com links, and that link to Phalanxaviation.com. Phalanxaviation.com does not control such websites and webpages and is not responsible for their contents or their use. Such links should not be interpreted as approval by Phalanxaviation.com of those linked websites or information you may obtain from them. By linking to a website or webpage, Phalanxaviation.com does not represent or imply that it endorses such website or webpage. You are responsible for taking precautions as necessary to protect yourself and your computer systems from viruses, worms, Trojan horses, logic bombs, and other material that is malicious or technologically harmful (collectively, the “Technologically Harmful Content”). Indemnification
The Customer agrees to indemnify and hold harmless and defend Phalanx Aviation member(s), officers, employees, and contractors from and against all claims and suits for damages, injuries to persons (including death), property damages, losses, and expenses including court costs and reasonable attorney’s fees, arising out of, or resulting from, Phalanx Aviation’s performance under this Agreement, including all such causes of action based upon common, constitutional, or statutory law, or based in whole or in part, upon allegations of negligent or intentional acts on the part of Phalanx Aviation, its officers, employees, agents, contractors, licensees, or invitees.
Arbitration
All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the state of Iowa. An award of arbitration may be confirmed in a court of competent jurisdiction.
Changes to Terms
Phalanx Aviation reserves the right, in its sole discretion, to change these terms. The most current version of the Terms will supersede all previous versions. Phalanx Aviation encourages you to periodically review the Terms to stay informed of our updates.
